These Terms & Conditions apply to products and services supplied by OUTR Sauna.

By placing an order with OUTR Sauna, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded or modified.

1. Pricing

All prices are displayed in Australian Dollars (AUD) and include GST where applicable unless otherwise stated.

We take reasonable care to ensure all prices, promotions and product information displayed on our website are accurate.

If an obvious pricing, typographical, technical or system error occurs, we may contact you before fulfilling the affected order and provide you with the option to proceed at the correct price or cancel the affected order for a full refund.

2. Orders & Acceptance

Placing an order constitutes an offer to purchase the selected products or services subject to these Terms & Conditions.

An order is accepted once OUTR Sauna confirms acceptance of the order or commences fulfilment.

We may decline an order where, for example, a product is unavailable, there has been an obvious pricing or listing error, payment has not been successfully processed, delivery to the nominated address is not reasonably available, or we reasonably suspect fraud or unauthorised activity.

If we cancel an order after receiving payment and the cancellation is not caused by a breach by the customer, amounts paid for the cancelled products or services will be refunded.

3. Product Information

We make reasonable efforts to ensure product descriptions, specifications, dimensions, photographs and other information are accurate.

Images displayed on our website are illustrative. The appearance of natural materials, including timber and stone, will vary between individual products.

Minor manufacturing improvements or specification changes may occur from time to time provided they do not materially reduce the functionality or quality of the product.

Screen settings, photography and lighting may also cause colours to appear differently from the physical product.

Nothing in this section permits OUTR Sauna to supply goods that do not comply with the Australian Consumer Law.

4. Natural Timber

Timber is a natural material. Variations in grain, knots, colour, tone, texture and appearance are normal characteristics of natural timber and are not, by themselves, defects.

Timber naturally responds to changes in temperature, moisture and humidity. Some expansion, contraction, checking, small surface cracks, movement and colour changes can occur during the life of a sauna.

5. Outdoor Installation & Timber Maintenance

Where a sauna is suitable for outdoor installation, it must be installed and maintained in accordance with the supplied instructions.

OUTR Sauna outdoor saunas incorporate weather-resistant materials and a dedicated roofing system; however, timber remains a natural material and requires ongoing care when exposed to outdoor conditions.

Exterior timber may require cleaning, recoating, painting, oiling or refinishing over time. Maintenance frequency will vary depending on exposure to sunlight, rain, humidity, salt air and other environmental conditions.

Normal weathering, fading or deterioration resulting from a failure to undertake reasonable maintenance is not necessarily a product defect.

Nothing in this section limits rights arising from a genuine manufacturing defect or other failure to comply with the Australian Consumer Law.

6. Site Preparation

Unless expressly included in your order, the customer is responsible for preparing a suitable installation site before delivery or installation.

The site must be reasonably:

  • level, stable and capable of supporting the sauna;
  • accessible for delivery and installation;
  • clear of obstructions;
  • adequately drained where appropriate; and
  • compliant with applicable building, electrical and other regulatory requirements.

The customer is responsible for confirming dimensions and available clearances before ordering.

Where installation cannot reasonably proceed because the site is unsuitable, inaccessible or materially different from information provided to us, reasonable additional attendance, labour, freight or rescheduling costs may apply where disclosed and agreed.

7. DIY Installation

Certain OUTR Sauna products may be suitable for customer assembly.

Where a customer chooses DIY installation, the sauna must be assembled in accordance with the instructions supplied with the product.

The customer is responsible for ensuring that anyone performing assembly is competent to perform the relevant work safely.

Damage caused by incorrect assembly, unauthorised modification, misuse or failure to follow installation instructions may not constitute a product defect and may not be covered by any additional voluntary warranty.

8. Electrical Installation

Electrical work must be undertaken by an appropriately licensed electrician where required by law.

For the SOL Sauna, this includes the electrical installation and connection of relevant components such as the Harvia heater, control equipment, Wi-Fi components and isolator where applicable.

Electrical installation must comply with applicable Australian standards, local requirements and manufacturer installation instructions.

We recommend using an electrician familiar with Harvia sauna equipment and control systems.

OUTR Sauna may provide details of independent electricians in certain areas. Unless the electrician is expressly contracted by OUTR Sauna to provide the relevant service, the electrician operates independently and the terms of their engagement are between the customer and electrician.

9. Professional Installation & Independent Contractors

Where professional installation is arranged through OUTR Sauna, installation may be performed by independent, appropriately qualified subcontractors engaged to carry out the relevant works.

OUTR Sauna requires its installation subcontractors to maintain appropriate licences, qualifications and insurance relevant to the services they perform.

The scope of installation is limited to the works specified in the customer's order or quotation. Unless expressly included, installation does not include electrical work, plumbing, structural works, concrete or foundation works, landscaping, crane hire, access modifications, rectification of existing structures, or other specialist works.

The customer is responsible for ensuring the installation location is safe, accessible, level, structurally suitable and ready for installation before the installer arrives.

Additional work resulting from unsuitable site conditions, restricted access, inaccurate information supplied by the customer, pre-existing defects or circumstances outside the agreed scope may incur additional charges. Any material additional charges will be communicated to the customer before additional work proceeds where reasonably practicable.

To the extent permitted by law, OUTR Sauna is not responsible for loss or damage caused by:

  • pre-existing defects or conditions at the property;
  • structures, surfaces, services or infrastructure not supplied or installed by OUTR Sauna;
  • inaccurate or incomplete site information provided by the customer;
  • work subsequently altered, removed or modified by the customer or another third party; or
  • acts or omissions of an independent contractor to the extent OUTR Sauna is not legally responsible for those acts or omissions.

Where loss or damage is caused by an installation subcontractor, OUTR Sauna may assist the customer in identifying the relevant contractor and facilitating an appropriate claim, including against the contractor's insurance where applicable.

10. Delivery

Delivery charges and inclusions will be displayed at checkout, stated in your quotation or otherwise agreed before purchase.

Unless otherwise stated, delivery is to a reasonably accessible delivery point at the nominated address.

The customer must provide accurate delivery and access information.

Standard freight may not include services such as crane delivery, difficult-access delivery, stairs, steep or restricted driveways, carrying the sauna through a property, unpacking, positioning or installation.

Where specialist delivery is required because of the location or access conditions, additional reasonable charges may apply where agreed with the customer.

11. Delivery Timeframes

Any delivery date or timeframe provided is an estimate unless expressly stated otherwise.

Delivery can be affected by manufacturing schedules, freight networks, weather, port delays, transport disruptions and other circumstances.

We will take reasonable steps to supply your order within the agreed timeframe or, where no timeframe has been agreed, within a reasonable time.

12. Delivery Access & Failed Delivery

The customer must ensure that the nominated delivery address is accessible for the type of vehicle reasonably required to deliver the product.

If delivery cannot be completed because information supplied by the customer was incorrect or incomplete, access was unavailable, or no authorised person was available where one was reasonably required, the customer may be responsible for reasonable redelivery, storage or additional freight costs.

We recommend discussing unusual or difficult access with OUTR Sauna before ordering.

13. Delivery Inspection & Freight Damage

Customers should inspect the external packaging and product as soon as reasonably practicable after delivery.

Where visible freight damage is identified, please photograph the packaging and affected area and contact OUTR Sauna promptly. Retaining photographs and packaging may assist us in pursuing the freight provider and resolving the matter faster.

14. Change-of-Mind Cancellations

Australian Consumer Law does not generally require a business to provide a refund merely because a customer changes their mind.

Subject to the remainder of this section, OUTR Sauna may allow cancellation of a standard order before dispatch.

Where OUTR Sauna agrees to a change-of-mind cancellation, any reasonable, non-recoverable costs already incurred specifically in relation to the order may be deducted from the refund where legally permitted and appropriately disclosed.

Orders that have been customised, specially manufactured or modified at the customer's request may not be eligible for change-of-mind cancellation once production or customisation has commenced.

15. Deposits & Instalment Arrangements

Where a deposit or instalment payment arrangement is offered, the applicable payment and cancellation terms will be disclosed at the time of purchase.

If the payment arrangement constitutes a lay-by agreement under the Australian Consumer Law, the statutory lay-by rules apply. A customer can cancel a lay-by before receiving the goods and is generally entitled to amounts paid less a disclosed termination fee that does not exceed the supplier's reasonable costs.

16. Sale & Promotional Items

Sale or promotional pricing does not reduce or remove a customer's rights under the Australian Consumer Law.

Unless otherwise stated, promotional offers apply only during the advertised promotional period and cannot be retrospectively applied to purchases completed before the promotion commenced.

A change-of-mind policy may have different conditions for promotional products where those conditions are clearly disclosed. However, customers retain their statutory rights where a product fails to comply with a consumer guarantee.

17. Promotions

Promotional offers, discount codes, free delivery offers, bundled products and other incentives are subject to the conditions advertised with the relevant promotion.

Unless expressly stated otherwise:

promotions cannot be combined with another promotion or discount; offers apply only during the advertised period; and promotions cannot be retrospectively applied to completed orders.

Where a promotion has limited quantities, it may end when the advertised allocation has sold out.

18. Warranties

OUTR Sauna products may include additional voluntary warranties. The applicable warranty period and conditions are set out on our Warranty page and/or warranty documentation supplied with the product.

Any manufacturer's warranty, including a warranty provided by Harvia, is additional to rights available under the Australian Consumer Law.

A manufacturer's warranty expiring does not necessarily mean that a customer's rights under the Australian Consumer Law have expired. ACCC guidance expressly states that consumer-guarantee rights can continue beyond a written warranty period.

Where registration is required to obtain an additional manufacturer's warranty benefit, customers should complete the manufacturer's registration process within the required timeframe.

19. Australian Consumer Law

The following wording applies to goods supplied to consumers and is the mandatory wording specified for warranties against defects:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights exist independently of any additional warranty provided by OUTR Sauna or a manufacturer.

20. Warranty Claims

If you believe there is a fault with your sauna or any component, please contact OUTR Sauna using the contact information below.

We may reasonably request information necessary to assess the issue, including:

  • proof of purchase;
  • photographs or video of the issue;
  • the product or component serial number;
  • information regarding installation;
  • electrician details where relevant; and
  • reasonable diagnostic information.

Where appropriate, OUTR Sauna or the relevant manufacturer may need to inspect or test the product before determining the appropriate remedy.

A business is generally entitled to assess a product before providing a remedy.

21. Harvia & Other Third-Party Components

Certain OUTR Sauna products incorporate components manufactured by third parties, including Harvia heaters and control equipment.

These components may be covered by their manufacturer's warranty in addition to any rights available against OUTR Sauna under Australian law.

Where appropriate, we may assist customers with manufacturer warranty processes.

22. Misuse, Modification & Improper Installation

Additional voluntary warranties may not cover damage caused by matters including:

incorrect installation; installation contrary to supplied instructions; unauthorised alterations; misuse or abuse; inappropriate electrical supply; use of unsuitable chemicals or cleaning products; failure to perform reasonable maintenance; or damage caused by external events.

23. Sauna Use & Safety

Customers must use the sauna and associated equipment in accordance with supplied operating instructions and manufacturer recommendations.

Sauna equipment can involve high temperatures, hot surfaces, electricity and water applied to heated sauna stones.

Children and other persons requiring supervision should not use the sauna unsupervised.

Customers are responsible for determining whether sauna use is appropriate for their personal circumstances and should seek appropriate professional medical advice where necessary.

24. Water on Sauna Stones

Water should only be applied to sauna stones and heaters in accordance with the heater manufacturer's instructions.

Do not pour water onto electrical controls, lighting, sensors or other components not designed for direct water exposure.

Damage resulting from misuse does not necessarily constitute a defect in the product.

25. Ownership & Risk

Ownership of goods passes to the customer once the purchase price has been paid in full, subject to applicable law.

Risk of loss or damage will pass in accordance with applicable law and the agreed delivery arrangements.

Nothing in this clause limits any responsibility OUTR Sauna may have for damage occurring during delivery where OUTR Sauna remains legally responsible for that delivery.

26. Post-Warranty Parts & Support

OUTR Sauna intends to provide reasonable after-sales support and access to replacement components where reasonably available.

Where a component requires replacement outside an applicable warranty or statutory remedy, we may offer replacement parts at a reasonable cost.

Availability and pricing of components may change over time.

27. Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, OUTR Sauna is not liable for losses caused by matters outside our reasonable control or losses resulting from customer misuse, unauthorised modification, unsuitable site conditions, failure to maintain the product, or work performed by an independent third party for whom OUTR Sauna is not legally responsible.

28. Trades Engaged Directly by the Customer

I'd then make your other contractor section specifically cover trades you recommend but the customer hires themselves:

Where OUTR Sauna provides the name or contact details of an electrician, builder, landscaper or other tradesperson as a recommendation only, and the customer contracts with and pays that tradesperson directly, that tradesperson is an independent service provider and is not engaged by OUTR Sauna.

The customer is responsible for confirming the contractor's qualifications, licensing, insurance, pricing and suitability before engaging them.

OUTR Sauna is not a party to the agreement between the customer and that independent tradesperson and, to the extent permitted by law, is not responsible for their workmanship, conduct, representations, charges, delays, acts or omissions.

29. Website Availability

We may update our website, product range, specifications, pricing and promotions from time to time.

We do not guarantee that our website will be uninterrupted or error-free at all times.

Changes made after a customer's order will not retrospectively alter an accepted order except where agreed with the customer or otherwise permitted by law.

30. Intellectual Property

All OUTR Sauna branding, website content, product photography, graphics, written content and other intellectual property owned by OUTR Sauna remain the property of OUTR Sauna or the applicable rights holder.

Content may not be reproduced, distributed or used commercially without prior written permission except where permitted by law.

31. Privacy

Personal information collected through purchases, enquiries, deliveries and warranty claims will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

Customers should review our Privacy Policy for further information regarding how personal information is collected, used, stored and disclosed.

32. Governing Law

These Terms & Conditions are governed by the laws applicable in Queensland, Australia, subject to any rights a customer has under applicable Commonwealth, state or territory legislation.

Nothing in this clause is intended to restrict a consumer's right to bring a claim in a jurisdiction available to them under applicable law.

33. Changes to These Terms

We may update these Terms & Conditions from time to time.

The terms applicable to an order will generally be those in effect when the order is placed, except where a subsequent change is required by law or is agreed with the customer.
